Environmental Law and Large-Scale Environmental Litigation

As is mentioned in the section regarding the Overview of the Centenary, it is one of the major features of our firm that we have been continuously involved for long period of time in large-scale litigations related to the environmental law including pollution litigations, representing defendant corporations.

Large-scale environmental litigations not only attract high level of public attention but also entail high risk of seriously affecting corporate activities from such aspects as corporate finances. It is needless to say that it is of significant social importance to bring such cases to appropriate settlement.

In order to be able to represent clients in large-scale environmental litigations, attorneys in charge need not only to be highly skilled and experienced in litigation strategies and tactics but also to have comprehensive and sufficient understanding of vast range of subjects including physics, engineering, earth science, medical science, statistics, epidemiology, social welfare system and other related social systems and social background and purposes of various relevant legislation. Further, it is often required to question, cross-examine and/or seek expert opinion from Japan’s excellent experts in respective fields. Iwata Godo, in cooperation with the department in charge in the respective corporations, has been systematically dealing with many such cases forming a team of attorneys led by highly experienced attorneys.

As the public became more aware of global environmental issues such as global warming, more attention is now paid to monitor how corporations are responding to regulations regarding earth, water and/or air pollution and prohibition/restriction of emission of hazardous materials and wastes. Reflecting such trend of the times, Iwata Godo also offers such services as (i) conducting investigation and providing advice on laws and regulations concerning environment as a part of legal services regarding real estate transactions or M&As and (ii) providing client companies with advice on compliance with environment related laws and regulations. Further legal services we offer in this area include provision of advice and documentation services regarding environment related business schemes such as the emission trading in connection with prevention of global warming and development and financing of renewable electricity generation facilities under the so-called Feed-In Tariff Law.

Being acknowledged of the expertise in environmental law, one of the attorneys of Iwata Godo has been appointed recently by the government authority as a council member.
